Croatia not scrapping arrest warrant for MOL's Hernadi

Croatia is not giving up the arrest warrant for Hungarian oil company MOL CEO Zsolt Hernadi and has requested explanations from the countries which refuse to act on it, Croatian Justice Minister Orsat Miljenic said in Brussels on Friday.

Austria and Germany recently informed Croatia that they were no longer after Hernadi, for whom an Interpol arrest warrant and a European Arrest Warrant have been issued. The two countries cited the rule under which one person cannot be tried for the same crime twice. Hungary issued an indictment against Hernadi similar to Croatia's and a Hungarian court acquitted him.

"We requested an explanation from those countries, which cite the rule that one can't try the same crime twice. However, that's absurd, because a private suit was filed in Hungary and if that standard applied, the European Arrest Warrant would come into question, since everybody would initiate a private suit and then could not be extradited. We will go through with this and clear this up because there are other European institutions, such as the Court in Luxembourg, so we will arrive at a solution," Miljenic said.

He was in Brussels to attended an extraordinary meeting of EU justice and interior ministers.
