Rijeka municipal prosecutor with no comment on Sindicic's release

The Municipal Prosecutor's Office in Rijeka which has requested Spain to extradite former Yugoslav secret agent Vinko Sindicic, suspected of perjury in Munich, has declined to comment on a ruling by a court in Madrid rejecting the extradition and has said that it is waiting to receive that ruling.

"The prosecution does not comment court decisions whether it be domestic or foreign. After it receives the court ruling it will examine it in accordance to the Law on Mutual Assistance in Criminal Matters between Member States," deputy county prosecutor Darko Karlovic wrote in an e-mail.

The investigative court in Madrid on Monday rejected a request by the Rijeka Municipal Prosecution Office for Sindicic's extradition after he was arrested on 9 November in the town of Burgos in northern Spain. 

The trial chamber, presided by Judge Alfonzo Guevara Marcos, concluded  that Croatia's extradition request  is unfounded as it was not requested by Germany where the alleged offence took place. 

Sindicic was a witness at a trial against UDBA agent Krunoslav Prates, who was sentenced in Munich in 2008 to life imprisonment as an accomplice in the murder of Croatian dissident Stjepan Djurekovic near Munich in 1983.

Sindicic is suspected of perjury and falsely reporting a crime in Munich at a trial against two other former Yugoslav UDBA intelligence agents - Josip Perkovic and Zdravko Mustac. Perkovic's defence attorney Anto Nobilo has claimed that Sindicic testified falsely which jeopardised his client who is charged with organising Djurekovic's murder. An international arrest warrant was issued by the Rijeka prosecution in February 2014.

Sindicic was arrested two months ago in Burgos in the vicinity of his defence attorney's office.  Sindicic was released on Monday. 

Vinko Sindicic had been sentenced in 1998 to 15 years in prison for an assassination attempt against Croatian dissident Nikola Stedul in Scotland. He served two-thirds of that sentence. He was tried again in 2000 in Croatia for the 1978 murder in Paris of another dissident, Bruno Busic, however, he was acquitted of that crime.
