Madrid court rejects extraditing Sindicic to Croatia

The investigative court in Madrid has rejected a request by the Rijeka Municipal Prosecution Office for the extradition of a former Yugoslav intelligence service agent, Vinko Sindicic, suspected of perjury and falsely reporting a crime in Munich at a trial against two other former Yugoslav UDBA intelligence agents - Josip Perkovic and Zdravko Mustac.

The trial chamber, presided by Judge Alfonzo Guevara Marcos, concluded  that Croatia's request for  Sindicic's  (72) extradition is unfounded as it was not requested by Germany where the alleged offence took place. 

Sindicic was a witness at a trial against UDBA agent Krunoslav Prates, who was sentenced in Munich in 2008 to life imprisonment as an accomplice in the murder of Croatian dissident Stjepan Djurekovic.

Perkovic's defence attorney Anto Nobilo has claimed that Sindicic testified falsely which jeopardised his client who is charged with organising Djurekovic's murder. An international arrest warrant was issued by the Rijeka prosecution in February 2014.

Sindicic was arrested two months ago in Burgos in northern Spain and objected to the extradition. The court initially ruled in favour of the extradition, however, Sindicic's defence attorney appealed that ruling and the matter was referred to a higher court.

The court of a higher instance, presided by Judge Marcos, on January 4 ruled against the extradition and Sindicic was released after spending 55 days in custody.
